Την απάντηση έδωσε το Πρωτοβάθμιο Πειθαρχικό Συμβούλιο του ΙΚΑ που εξέτασε την υπόθεση στις 15/6/2009 και κατέληξε στο συμπέρασμα ότι «ο εγκαλούμενος υπάλληλος απουσιάζει αυθαίρετα από την υπηρεσία (ΝΜΥ ΙΚΑ) κατά το χρονικό διάστημα 11/3/2005 έως 15/6/2009 και συνεχίζει να μισθοδοτείται από το ΙΚΑ». Συγκεκριμένα σημειώνεται ότι το δεύτερο φύλλο κίνησης συντάχθηκε με προφορική εντολή διευθυντή της ΝΜΥ χωρίς να υπάρχουν τα νομιμοποιητικά έγγραφα απόσπασης, ενώ ακόμη και οι ενέργειες να ήταν σύννομες, θα έπρεπε να ενημερωθούν οι αρμόδιες διευθύνσεις του ΙΚΑ για τα περαιτέρω, όπως η διακοπή της μισθοδοσίας.

Δεν ήμουν εργάτης. Πήγαινα 6-7 το πρωί και έφευγα το βράδυ, ενώ ήμουν και στην πυρ Ασφάλεια στο Αλσος Φιλαδέλφειας».
